How do you institute a claim?

·        \r\nContact the opposing party (the\r\nperson against whom you are instituting a claim) with a request to satisfy your\r\nclaim. This may be done through a face to face verbal demand or a telephone\r\ncall.

\r\n\r\n

·        \r\nIf the opposing party does not\r\ncomply with your verbal request, address a written demand to him or her,\r\nsetting out the particulars of the facts on which your claim in accordance with\r\nschedule 1 of the SCP rules.

\r\n\r\n

·        \r\nDeliver the demand notice by hand\r\nto the opposing party.

\r\n\r\n

·        \r\nIf after 14 days the opposing\r\nparty does not respond to the demand notice, report in person to the clerk of\r\nthe SCP at your local court, with your proof that the demand notice was\r\ndelivered to the opposing party.

\r\n\r\n

·        \r\nTake along any contract, document\r\nor other proof upon which your claim is based or that has a bearing on your\r\nclaim.

\r\n\r\n

·        \r\nTake the full name and address\r\n(home and business address if known) and telephone contacts of the opposing\r\nparty.
